General Terms and Conditions
1. Conclusion of Contract
The display of goods in our online store does not constitute a legally binding offer, but rather a non-binding online catalogue. Goods can be ordered using the shopping cart. You can place a selected item in your cart by clicking the "Add to Cart" button. By clicking the cart icon in the top right corner, you can view the items in your cart, change their quantities, and remove them.
When you have finished shopping, click "Proceed to Checkout." You may place your order as a guest, but during the ordering process you also have the option to register an account or log in to an existing one. Before finalizing your order, you can review the checkout page to check for any incorrect information and correct it if necessary. Finally, click the "Order" button to submit your order for the items in your cart.
Once we receive your order, you will immediately receive an order confirmation; however, this does not constitute our acceptance of the contract. The order is deemed accepted once we send you an email confirmation — for card payments, together with the final invoice. For bank transfer payments, the final invoice issued after the transfer made based on the payment request is considered the accepted order.
2. Right of Withdrawal
2.1 Right of Withdrawal (within 14 days)
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.
2.2 Exercising the Right of Withdrawal
If you wish to exercise your right of withdrawal, you may send us an unambiguous statement of your intention to withdraw by:
- email to info@boodabike.com, or
- our online contact form: help.boodabike.com/contact-us
Please include your order number and specify the item(s) you wish to return in your withdrawal statement. We will confirm receipt of your statement electronically without delay. You will have met the withdrawal deadline if you send your withdrawal statement before the deadline above has expired.
2.3 Refunds and Withholding
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and, in any event, no later than 14 days from the day on which we receive your withdrawal statement. We will use the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the goods back and inspected them.
2.4 Returning the Goods and Return Costs
You must return or hand over the goods without undue delay and, in any event, no later than 14 days from the day on which you communicate your withdrawal from this contract. The deadline is met if you send the goods back before the 14-day period has expired. The direct cost of returning the goods will be borne by you. Booda Bike is unable to accept parcels sent as ordinary mail.
2.5 Diminished Value and Liability for Use
You are liable for any diminished value of the goods only if such diminished value results from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. The following cases in particular constitute use going beyond mere inspection and testing, and therefore result in a 100% loss of value (i.e., loss of "as-new" condition):
- Used, soiled, scratched, or damaged products.
- Bicycle bags and accessories that were mounted on a bicycle and used outdoors.
- Hubs, rims, and spokes that have been laced into or assembled as a wheel.
- Moving, rotating, or drivetrain components (e.g. belts, pulleys, bearings, pedals, drivetrain parts) that have been installed, put into operation, or used.
2.6 Booda Bike 90-Day Extended Return Guarantee (beyond 14 days)
After expiry of the statutory 14-day withdrawal period, between the 15th and 90th day from purchase (receipt), Booda Bike voluntarily offers an additional return option, subject to the following strict conditions:
- The extended return applies only to products that are completely unused, undamaged, in their original packaging, and in resaleable condition.
- For returns made during this period, Booda Bike will refund 90% of the product's original purchase price.
- The cost of returning the product remains the customer's responsibility in this case as well.
- The original delivery fee for the product will also be deducted from the refund amount (even if the customer received a free-shipping discount at the time of purchase).
3. Exclusion / Expiry of the Right of Withdrawal
The right of withdrawal cannot be exercised in respect of:
- non-prefabricated goods manufactured according to the consumer's specifications or clearly personalized to the consumer;
- goods liable to deteriorate or expire rapidly;
- sealed goods which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery.
3.A. Special Cancellation Rules for Custom-Modified Bicycles
What constitutes a custom modification: If, when ordering a bicycle, the customer requests a custom modification to the factory/base configuration (e.g. component substitution such as a different type or size of tyre, handlebar, saddle, drivetrain, extra lights, or any other part requiring installation), the product is, under applicable law, deemed to be made to the consumer's specifications and personalized at the consumer's express request.
Exceptions (easily removable accessories): Ordering accessories that do not affect the bicycle's base structure and can be easily fitted and removed (e.g. bell, bicycle bag, rear rack, bottle cage, etc.) does not constitute a custom modification.
Cancellation before dispatch/shipping: If the customer cancels an order for a bicycle with custom modifications before the product has been handed over to the carrier/courier for dispatch, the Provider is entitled to deduct from the refund, as a handling and modification fee, an amount covering the costs incurred for assembly, modification, and administrative work — equal to 10% of the gross purchase price of the custom bicycle, up to a maximum of €100 (or the equivalent amount in Hungarian forints).
4. Delivery
We deliver goods not only within the European Union. With the exception of complete bicycles, deliveries are generally carried out by Packeta or UPS. Complete bicycles ordered are delivered by FedEx, national postal services, or other shipping providers. We are only able to sell our products in retail quantities and only to end users.
5. Warranty
If the delivered product shows a visible material or manufacturing defect, including damage sustained during shipping, please notify us of the defect without delay after discovering it, and in any case within 14 days of discovery — by email to info@boodabike.com, or to the carrier's representative upon receipt of the goods. Please note that you may no longer assert your statutory warranty rights after the two-year limitation period from performance of the contract has elapsed.
Under your statutory warranty rights, you may choose to request repair or replacement, unless the chosen remedy is impossible or would impose disproportionate additional costs on the business compared to the alternative remedy. If repair or replacement was not requested or could not be requested, you may claim a proportionate price reduction, have the defect repaired or have it repaired by a third party at the business's expense, or, as a last resort, withdraw from the contract. You are not entitled to withdraw from the contract in the case of a minor defect.
You may switch from your originally chosen warranty remedy to another, but you will bear the cost of doing so, unless the switch was justified or caused by the business. Within one year of performance, no condition other than notification of the defect applies to enforcing your warranty claim. After one year from performance, however, you must prove that the defect you have identified already existed at the time of performance.
In the event of a defective product, you may — at your choice — assert either the statutory warranty right described above or a product liability claim. Under a product liability claim, you may only request repair or replacement of the defective product. A product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or does not have the characteristics described by the manufacturer. You may assert a product liability claim within two years from the date the product was placed on the market by the manufacturer, and only against the manufacturer or distributor of the movable item. You must prove the defect yourself when asserting a product liability claim.
The manufacturer (distributor) is exempt from product liability only if it can prove that:
- it did not manufacture or place the product on the market in the course of its business activity; or
- the defect was not detectable according to the state of science and technology at the time the product was placed on the market; or
- the defect arose from compliance with a legal provision or mandatory regulatory requirement.
Please note that you cannot assert a statutory warranty claim and a product liability claim simultaneously and in parallel for the same defect. However, if your product liability claim is successful, you may assert a statutory warranty claim against the manufacturer for the replaced product or repaired part.
5.1 Definition of Consumer and Eligibility to Withdraw
The above right of withdrawal is granted, under the Civil Code and the applicable government decree, exclusively to buyers who qualify as consumers. A consumer is a natural person acting outside the scope of their profession, self-employed occupation, or business activity. Accordingly, the right of withdrawal cannot be exercised by non-natural persons (e.g. companies, associations, foundations), nor by natural persons who purchase the product in the course of their profession, sole trader activity, or business activity (e.g. by requesting an invoice with a tax number).
5.A. Mandatory Warranty
Customers are entitled to statutory warranty rights for a period of 2 years from purchase/receipt. An exception applies to Hungary, where the following rules apply:
Under the Civil Code and Government Decree 151/2003 (IX. 22.), the Provider is subject to a mandatory warranty obligation on its products where the buyer qualifies as a consumer under applicable law. The warranty period depends on the sale price of the product, as follows:
- 1-year warranty for a sale price of HUF 10,000 up to but not exceeding HUF 100,000.
- 2-year warranty for a sale price exceeding HUF 100,000 up to but not exceeding HUF 250,000.
- 3-year warranty for a sale price exceeding HUF 250,000.
Start of the warranty period: The warranty period begins on the date the product is handed over to the consumer, or, if installation is carried out by the Provider or its agent, on the date of installation.
Rights under the warranty: Based on a warranty claim, the consumer may choose to request repair or replacement, unless the chosen remedy is impossible or would result in disproportionate additional costs to the Provider compared to the alternative remedy. If the Provider has not undertaken repair or replacement, or cannot fulfil this obligation within a reasonable deadline, the consumer may request a proportionate reduction of the consideration or withdraw from the contract (withdrawal is not available for a minor defect).
Exceptions and exemption: The Provider is exempt from its warranty obligation only if it proves that the cause of the defect arose after performance (e.g. due to improper use, mechanical damage, improper storage, or lack of maintenance).
5.2 Use of External Service Providers and Cost Reimbursement Rules
- Approval requirement: Booda Bike will only pay or reimburse an invoice issued by an independent third-party bicycle repair shop chosen by the customer if Booda Bike customer service has approved, in writing (by email) and on a case-by-case basis, the reported defect and the repair before work begins, and has expressly authorized the repair up to a specified amount.
- Lack of prior approval: If the customer has a repair carried out by a third-party service provider without Booda Bike's prior written approval, Booda Bike is released from any obligation to reimburse the repair costs.
- Submission of a quote: The customer must send Booda Bike a detailed quote from the third-party service provider before repair work begins.
- Right to propose an alternative: If the quote, hourly rate, or estimated total cost provided by the third-party service is disproportionately high relative to the nature of the repair, Booda Bike reserves the right to refuse approval and propose an alternative solution. This may include, but is not limited to, designating another nearby service provider or arranging for the bicycle to be collected by its own courier and repaired at Booda Bike's own workshop.
6. Shipping Costs
The Provider ships ordered products divided into categories, taking the destination country into account. The shipping fee varies depending on the size of the package and the delivery address.
6.A. Shipping Category Definitions
Based on their size and weight, products fall into one of the following three logistics categories:
- Small shipping category (general products): smaller accessories and parts that can be handled as standard parcels.
- Medium shipping category (wheels and larger products): wheelsets, frame sets, and other items that are larger than average but not oversized.
- Large shipping category (bicycles and large products): complete bicycles and other large shipments requiring special handling.
6.B. Country-Specific Pricing
Shipping fees vary by country. The applicable fee is calculated and displayed by our system during checkout, after the delivery address has been entered.
6.C. Special Provisions for Shipping Outside the EU
For complete bicycles shipped to countries outside the European Union, the Provider reserves the right to dispatch the product in two separate packages (boxes). This may be done to ensure safe shipping conditions and to comply with international logistics regulations.
7. Payment
Payment by bank card: You can pay immediately during the ordering process by entering your bank card details. Our online payment gateway provider is Stripe (www.stripe.com). Neither party stores your bank card details after the order is placed, and under no circumstances can we charge your card again after your purchase.
Payment by bank transfer: During the ordering process, you also have the option to select bank transfer as your payment method. In this case, upon finalizing your order you will automatically receive a payment request prepared by us, containing the exact transfer details for your order. Please always include your order or invoice reference in the transfer notes for clear identification.
8. Prices
Our prices are quoted in Hungarian forints and include statutory VAT (gross prices). We make every effort to ensure that the prices in our online store are accurate; however, if incorrect prices are nevertheless displayed, we are not obliged to sell the product at the incorrect price. In such cases, we may offer you the product at the correct price, and you are entitled to withdraw from the contract as described in Section 2 above. Prices that are obviously incorrect or disproportionate are considered erroneous in particular.
9. Retention of Title
The goods remain our property until payment has been made in full.
10. Alternative Dispute Resolution
If any issue arises in connection with your online purchase that cannot be resolved directly with us, you may submit a complaint to the conciliation body competent for your place of residence or stay. In Hungary, the Budapest Conciliation Board is authorized to handle cross-border disputes:
1016 Budapest, Krisztina krt. 99. 3rd floor, room 310, HungaryEmail: bekelteto.testulet@bkik.hu
A list of the competent dispute-resolution bodies in each EU member state is available on the European Commission's website: consumer-redress.ec.europa.eu
11. International Orders (Outside the EU)
Import duties and taxes: For orders shipped outside the European Union, additional import duties, customs charges, and local taxes may be applied once the parcel arrives in the destination country. These charges are the responsibility of the recipient and are separate from the shipping costs paid at checkout.
Estimated costs: Unfortunately, we are unable to provide an accurate estimate of these charges, as they vary by country and order value. For more precise information, we recommend contacting your local customs office to obtain information relevant to your specific situation.
